COMMON LAW 1.ĐẶC ĐIỂM CƠ BẢN CỦA DÒNG HỌ PHÁP LUẬT COMMON LAW - Common law là dòng họ pháp luật ít nhiều chịu ảnh hưởng của HTPL Anh và thừa nhận án lệ như nguồn luật chính thức. Các phán quyết đã tuyên của tòa án cấp trên nói chung có giá trị ràng buộc toà án cấp dưới trong quá trình xét xử các vụ việc hiện tại. Tuy nhiên, trong vài thập kỷ gần đây, trong các hệ thống pháp luật này, án lệ không còn là nguồn luật duy nhất mà pháp luật thành văn đã ngày càng trở thành nguồn luật quan trọng, thậm chí là nguồn luật quan trọng hàng đầu, đặc biệt đối với những lĩnh vực không có án lệ. - Thẩm phán đóng vai trò quan trọng trong việc phát triển và sáng tạo các QPPL. Xét HTPL Anh- cội nguồn của Common law, có thể thấy, ở Anh không có bộ luật để chứa đựng hết các QPPL thậm chí không có Hiến pháp thành văn. Khi xét xử các vụ án, các thẩm phán có xu hướng nghiên cứu kĩ các tình tiết vụ việc và đề cao tính chính xác. Vậy nên, họ thường xem xét một hoặc nhiều những vụ án tương tự để đưa ra quyết định cuối cùng. Tuy nhiên, nếu giải pháp pháp lí cho vụ việc được tìm thấy trong cả án lệ và luật thành văn và giữa hai nguồn luật này có sự mâu thuẫn, về nguyên tắc, pháp luật thành văn được ưu tiên áp dụng. - Nhìn chung các hệ thống pháp luật thuộc dòng họ Common law không có sự phân biệt giữa công pháp và tư pháp, trừ HTPL Anh. Tuy nhiên, ở Anh, việc phân biệt hai mảng luật này là nhằm xác định thủ tục tố tụng nào cần áp dụng để giải quyết vụ việc có liên quan; trong khi đó ở các nước thuộc dòng họ Civil law, sự phân biệt này nhằm xác định thẩm quyền của toà án giải quyết vụ việc cần đưa ra toà. - Chế định pháp luật tiêu biểu của các HTPL thuộc dòng họ Common law là chế định uỷ thác. Chế định uỷ thác trong dòng họ Common law ra đời gắn liền với nhu cầu giải quyết tranh chấp đất đai phát sinh từ hợp đồng uỷ thác đất đai ở Anh thời trung cổ nhằm đưa ra giải pháp công bằng đối với người được uỷ thác có hành vi chiếm dụng đất đai của người uỷ thác trong quá trình thực hiện hợp đồng uỷ thác đất đai.
